8 Indemnity  
  You hereby indemnify, defend, and hold harmless SeaQuation and/or any of its predecessors, successors, parents, subsidiaries, affiliates, officers, directors, shareholders, investors, employees, agents, representatives, and/or lawyers (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable legal fees, incurred by the Indemnified Parties in connection with any claim arising out of or relating to any breach by you of this Agreement or the representations, warranties, and covenants you have made by agreeing to the terms of this Agreement. You shall cooperate as fully as reasonably required in the defence of any such claim. SeaQuation reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.  
9 Severance  
  If any of these Conditions of Use should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Conditions of Use shall survive and remain in full force and effect and continue to be binding and enforceable.  
10 Governing Law  
  These Conditions of Use shall be governed by and construed in accordance with the law of the Netherlands and you hereby submit to the exclusive jurisdiction of the Dutch courts.
